GS(14)@2011-06-25 16:33:20The judge finds that the court does not have jurisdiction to determine whether the defendants contravened section 295(1) of the SFO. If the SFC wants to take the matter further then it must either go to the Market Misconduct Tribunal, or to criminal prosecution.
法官發現法庭並無權力判定被告違反證券及期貨條例第295(1)條。如果證監會想採取進一步行動，跟著他們可以選擇市場失當行為審裁處或進行刑事檢控。
