街頭展示易拉架的檢控

檢控拾紙皮阿婆之二一文的留言, 引申了這篇的課題, 事緣是在HKSAR and TSE MAN FEI (謝文飛) FACC 1/2016, 終審法院駁回律政司上訴, 在街頭的易拉架檢控幾乎停頓了。在講下去之前先重溫一下案情, 我採用終審法院判辭的中文新聞摘要其中幾段:


1.  一名食物環境衛生署管工,觀察到受僱於有線寬頻的答辯人,在一條政府行人天橋上,在附有四張有線寬頻海報的紙架前,向一名女士推銷有缐寬頻計劃。
2.  答辯人被控在未獲有關主管當局准許下,在政府土地上展示招貼或海報,違反香港條例第132章《公衆衛生及市政條例》第104A(1)(b)及(2)條。裁判官裁定他罪名成立。答辯人提出上訴,高等法院暫委法官裁定答辯人並沒有設置涉案紙架,但支持裁判官的裁斷,裁定答辯人當時正站在海報旁向一名女士推銷有線寬頻服務。控方辯稱因答辯人站在海報旁和在參照海報下進行推銷活動,所以答辯人曾「展示」該等海報。暫委法官並不接納控方的論點,並撤銷答辯人的定罪。
3.  本上訴提出的問題是,控方須證明何等行爲,才能夠證明「展示」這一罪行元素?上訴人(控方)辯稱,除了實質展示之外,展示亦包括以下情況的「感知展示」:當被告人「出示或陳示;或以字詞描述或解釋那已經在未獲准許下被展示的海報的内容;或任何其他涉及持續在未獲准許下展示有關海報的作爲或行爲」。
4.  本案爭議點關乎法例釋義,本院須根據條文的文意和目的,解釋第104A條的用語。
終審法院考慮到立法背景後採用狹義釋法, 即104A是針對實際豎立起易拉架海報的人來檢控。就算本案的被告在有線寬頻易拉架海報附近推銷有線的服務計劃, 也沒有證據顯示易拉架是他豎立的, 所以判他無罪。Star Chamber的留言說是食環署用了錯誤章節來檢控, 應該用第104條, 我不同意這講法, 因為第104條並非一條罪行。如果終審法院的判決頒佈後, 食環署就停止檢控, 那麼我就要批評該署有失職之嫌, 食環署理應向律政司索取指引, 指示怎樣檢控滿街擠塞的易拉架展銷活動, 而並非因為終院的判決而洗手不幹, 這當然與前線低級職員無關, 因為法律的釋義並非他們的職能。咁標少批評人哋講得咁口響咁巴閉, 咁點告先? 我教你幾種方法:

1. 見到有人在開工豎起個易拉架來開檔, 即是斷正, 告第104A。

2. 去到已經開了檔, 看不到誰人豎起個易拉架, 誰在推銷就問誰, 承認那個就告那個。嘩咁講仲邊有人認?

3. 沒有人承認就沒收易拉架, 權力來自第104C, 然後

4. (以本案而言)告有線寬頻(作為一個法人), 引用104D。

告公司當然會麻煩。第一, 你要搞清楚公司個名, 但每一間只需查一次, 以後就不用查。第二, 104D有抗辯理由, 如果法庭信納公司不知情就要判無罪。實際上你想下, 公司派個代表上去作供, 三兩條問題就KO咗佢, 試問派得邊個上去可以講到知唔知情, 你畀我問我就問到佢話乜都唔知, 乜都唔知法庭點信佢? 就算甩到104D, 都可以充公個易拉架, 再用民事索取搬運費。你話, 我免費教食環做嘢, 事在人為呀。

做乜無端白事講呢單嘢, 因為前線吐苦水, 跟住有留言討論, 我唔記得晒一年前單判辭, 答晒電郵咪揾單嘢出嚟睇囉, 只不過60段有幾難明吖! 唔信我講咪自己睇囉, 尤其是第55段:

55. It was submitted that a narrow construction of “displayed” would lead to anomalous results in that a salesperson like the respondent could escape liability for a bill or poster whilst the person who physically set it up and whose goods were being advertised would not.[42] In his oral submissions, Mr Hui submitted that this would be “a problem” in that it would dent the effectiveness of the offence.  However, it is questionable whether this is an anomaly or problem as submitted.  In the present case, for example, it is not clear why i-CABLE was not prosecuted under s.104D(1)(b).  Had this occurred, responsibility for the posters in question would, subject to the proviso in s.104D(1), have been placed on the entity which would appear to have most benefitted from their unauthorised posting.  It may be that it would be of greater prosecutorial convenience to be able to issue a fixed penalty ticket on the spot to the person conducting the perceptive display, but this does not compel the construction contended for by the prosecution.  In any event, regardless of the offence provisions, the Government retains the ability to remove an unauthorised bill or poster under s.104C.
